Mas, juridicamente, a an\u00e1lise pode ser mais ampla.<\/p>\n\n\n\n<p>Dependendo do caso, o trabalhador pode ter direito n\u00e3o s\u00f3 ao encaminhamento previdenci\u00e1rio, mas tamb\u00e9m \u00e0 emiss\u00e3o de CAT, ao dep\u00f3sito de FGTS durante o afastamento acident\u00e1rio e \u00e0 estabilidade provis\u00f3ria no retorno ao trabalho. A Constitui\u00e7\u00e3o assegura seguro contra acidente de trabalho sem excluir a indeniza\u00e7\u00e3o quando houver dolo ou culpa do empregador.<\/p>\n\n\n\n<p>Na pr\u00e1tica, muitos trabalhadores n\u00e3o recebem orienta\u00e7\u00e3o suficiente no momento mais cr\u00edtico. E \u00e9 justamente a\u00ed que surgem erros relevantes: CAT n\u00e3o emitida, documenta\u00e7\u00e3o incompleta, retorno precoce, aus\u00eancia de prova das circunst\u00e2ncias do acidente e perda de direitos que poderiam ser discutidos judicialmente.<\/p>\n\n\n\n<p>Acidente de trabalho n\u00e3o deve ser tratado como simples fatalidade autom\u00e1tica.
