A condena\u00e7\u00e3o dos Supermercados Rena foi mantida pelo Tribunal Regional do Trabalho (TRT-MG), por unanimidade, por homofobia; al\u00e9m de discrimina\u00e7\u00e3o por orienta\u00e7\u00e3o sexual, a imposi\u00e7\u00e3o de pr\u00e1ticas religiosas e descontos salariais indevidos no contracheque de um de seus funcion\u00e1rios. A decis\u00e3o, publicada nesta ter\u00e7a-feira, 3, rejeitou embargos de declara\u00e7\u00e3o apresentados pela empresa e confirmou que houve viola\u00e7\u00e3o dos direitos do ex-funcion\u00e1rio.<\/p>\n\n\n\n

Al\u00e9m disso, o colegiado afastou o argumento de que as promo\u00e7\u00f5es recebidas pelo funcion\u00e1rio descaracterizariam o dano moral. Para os desembargadores, o crescimento profissional n\u00e3o elimina atos il\u00edcitos que atingem a dignidade do trabalhador.<\/p>\n\n\n\n

O supermercado, na cidade de Divin\u00f3polis, foi condenado pela Justi\u00e7a do Trabalho a pagar R$ 15 mil em indeniza\u00e7\u00e3o ao, agora, ex-funcion\u00e1rio. O TRT considerou pr\u00e1tica de homofobia.<\/p>\n\n\n\n

Relembre o caso<\/strong><\/p>\n\n\n\n

O funcion\u00e1rio da empresa, desde 2014, reclamou junto TRT-MG, ter sido v\u00edtima de homofobia desde a entrevista feita para sua contrata\u00e7\u00e3o.<\/p>\n\n\n\n

Em 2014 ele passou por uma psic\u00f3loga durante o recrutamento. A psic\u00f3loga anotou, entre os outros dados sobre o ex-funcion\u00e1rio, a palavra GAY, escrita em vermelho.<\/p>\n\n\n\n

O ex-funcion\u00e1rio n\u00e3o tinha conhecimento desta anota\u00e7\u00e3o e seguiu trabalhando na empresa.<\/p>\n\n\n\n

Em 2022, foi promovido ao cargo de subgerente, quando o cargo lhe dava acesso \u00e0s fichas dos empregados, no caso de ter que anotar alguma advert\u00eancia. Nesta \u00e9poca, ele consultou o pr\u00f3prio cadastro e viu a informa\u00e7\u00e3o anotada em vermelho.<\/p>\n\n\n\n

O ex-funcion\u00e1rio \u00e9 casado e junto com o companheiro adotou uma crian\u00e7a, j\u00e1 havia adotado outra anteriormente, lhe foi ent\u00e3o concedido o direito da licen\u00e7a-paternidade e, por causa disto, teria sido tamb\u00e9m alvo de coment\u00e1rios homof\u00f3bicos pelos colegas.<\/p>\n\n\n\n

A empresa foi condenada em repara\u00e7\u00e3o por danos morais no valor de R$ 15 mil.<\/p>\n\n\n\n

Recurso<\/strong><\/p>\n\n\n\n

O Supermercado recorreu da decis\u00e3o, mas recurso o relator, desembargador Lucas Vanucci Lins, manteve a decis\u00e3o anterior, ap\u00f3s an\u00e1lise dos argumentos da empresa.<\/p>\n\n\n\n

A empresa argumentou j\u00e1 que o ex-funcion\u00e1rio chegou a receber promo\u00e7\u00e3o de cargo, mas este argumento n\u00e3o foi aceito pelo ac\u00f3rd\u00e3o. \u201cO fato de o trabalhador ter obtido promo\u00e7\u00f5es n\u00e3o exclui a ocorr\u00eancia de atos il\u00edcitos que violaram direitos da personalidade\u201d.<\/p>\n\n\n\n

Assim, o colegiado entendeu que a conduta patronal ultrapassou o poder diretivo e atingiu a esfera ps\u00edquica do empregado, o que justifica a condena\u00e7\u00e3o por danos morais.<\/p>\n\n\n\n

Foram derrubados ainda os argumentos do supermercado n\u00e3o obrigava aos funcion\u00e1rios participarem de ora\u00e7\u00f5es no trabalho. Mas testemunhas afirmaram no processo que todos participavam porque \u201cficava chato se n\u00e3o fossem\u201d.<\/p>\n\n\n\n

Foi confirmada ent\u00e3o a condena\u00e7\u00e3o por descontos indevidos, discrimina\u00e7\u00e3o por orienta\u00e7\u00e3o sexual no trabalho e viola\u00e7\u00e3o da liberdade religiosa do empregado.
