A turma julgadora ainda acrescentou \u00e0 condena\u00e7\u00e3o uma indeniza\u00e7\u00e3o por danos morais de R\uff04 2 mil.<\/p>\n\n\n\n<p>O profissional ajuizou a\u00e7\u00e3o contra a montadora e a concession\u00e1ria pleiteando indeniza\u00e7\u00e3o por lucros cessantes, referente \u00e0 quantia que deixou de ganhar por ser impedido de trabalhar, e por danos morais.<\/p>\n\n\n\n<p>Ele afirma que adquiriu um ve\u00edculo zero km em 1\u00ba de novembro de 2019. No dia 4 do mesmo m\u00eas o carro apresentou defeito e teve que voltar \u00e0 concession\u00e1ria para reparos. O autom\u00f3vel s\u00f3 foi devolvido ao propriet\u00e1rio 12 dias depois, sendo que a empresa forneceu a ele um carro reserva apenas nos tr\u00eas primeiros dias.<br>\u00a0O motorista alegou ter sofrido preju\u00edzo profissional e danos morais, porque trabalha com transporte por aplicativo. Ambas as empresas rebateram as afirma\u00e7\u00f5es do cliente sob o argumento de que n\u00e3o houve danos pass\u00edveis de indeniza\u00e7\u00e3o e que o consumidor sofreu meros aborrecimentos<\/p>\n\n\n\n<p>Em 1\u00aa Inst\u00e2ncia, a tese foi parcialmente acolhida pelo juiz Jos\u00e9 M\u00e1rcio Parreira, que estipulou o valor da indeniza\u00e7\u00e3o por lucros cessantes, mas rejeitou o pedido de danos morais. O motorista recorreu, reiterando que sofreu danos morais que extrapolaram os problemas corriqueiros. O relator, desembargador Fernando Lins, acolheu o recurso.<\/p>\n\n\n\n<p>Para o magistrado, o fato de ficar sem o instrumento de trabalho e sem auferir renda, em raz\u00e3o de defeito verificado logo ap\u00f3s a aquisi\u00e7\u00e3o de ve\u00edculo 0 km, gera \u201cabalos que ultrapassam os meros aborrecimentos, devendo ser considerada ainda a enorme frustra\u00e7\u00e3o\u201d da pessoa que compra um carro novo diretamente da concession\u00e1ria e se v\u00ea dele privado em raz\u00e3o do v\u00edcio do produto.<\/p>\n\n\n\n<p>Os desembargadores L\u00edlian Maciel e Fernando Caldeira Brant
